1. Scope of application

These general terms and conditions apply to all business relationships between the client or purchaser and the contractor, Prof. Dr. Heinz R. Böhme gemeinnützigen Stiftung Salzburg, hereinafter referred to as Museum Kunst der Verlorenen Generation, with its registered office at Sigmund-Haffner-Gasse 12 in 5020 Salzburg, Austria, which are initiated via the Museum Kunst der Verlorenen Generation museum shop (https://verlorene-generation.com/shop/).

By placing an order in the online shop, customers accept the General Terms and Conditions ("GTC") of the Museum Kunst der Verlorenen Generation online shop.

 

2. Contract

An order can only be placed if all mandatory fields (fields marked with an asterisk) have been completed. Completing the order process and confirming the General Terms and Conditions constitutes an offer to conclude a purchase contract with the Museum Kunst der Verlorenen Generation. Receipt of the order will be confirmed by an automatically generated email. However, this does not constitute acceptance of the order. We only receive messages during normal opening hours (Tuesday to Friday from 10:00 to 17:00, except on public holidays in Austria). Messages received by the server outside these hours will only be considered received on the next working day. We reserve the right to reject orders in whole or in part. Customers will be informed if their order is not accepted. If you have already made advance payments for goods that have not been delivered, we will refund these payments.

 

3. Prices

The prices of the Museum of Lost Generation Art apply in accordance with the currently valid price lists or as stated in the online shop. The prices include the applicable statutory value added tax. The Museum of Lost Generation Art reserves the right to set prices that deviate from the price lists in individual cases. These will be indicated during the ordering process. Prices are subject to change. If the correct price is higher, the customer will be contacted; in this case, a contract will only be concluded if the customer wishes to purchase at the actual price. If the correct price is lower, the lower price will be charged. The shipping costs stated in the order apply.

 

4. Delivery times for shipping goods

Goods purchased online and in stock (catalogues, etc.) will be shipped by the Museum of Lost Generation Art within a reasonable period of time after receipt of payment. If paying by credit card, the goods will be shipped after the credit card has been verified, and if paying in advance, after full payment has been received in our account. Domestic and international shipments will be sent to the address provided when ordering. We reserve the right to make partial deliveries. If an item is unavailable for at least four weeks, we will notify the customer by email and give the customer the opportunity to withdraw from the purchase contract for the unavailable items by sending us a written declaration by email. If customers do not exercise this right of withdrawal within the period specified by us, the contract remains valid and will be fulfilled by us as soon as the goods are available again.

 

5. Payment

Payment is made by credit card or prepayment. Only after receipt of the order will the staff of the Museum of Lost Generation Art contact the customer to clarify all further steps of the payment and shipping process. Only after clarification of the payment process is the sales transaction completed. The purchase is then binding and can no longer be cancelled or modified, unless there is a statutory right of withdrawal. However, the purchase contract is only concluded if the booking process has been carried out with a valid credit card and the payment process has been authorised by the respective credit card company or, in the case of prepayment, the payment has been received in full in our account.

 

6. Retention of title

Goods remain the property of the Museum of Lost Generation Art until full payment has been received.

 

7. Warranty and liability

The statutory warranty provisions apply.
The website has been created to the best of our knowledge and tested conscientiously. Nevertheless, no liability can be accepted for the functions on the website being error-free, for errors being corrected or for the website or server being free of viruses or other harmful programmes, functions or similar. Claims for damages by the customer for any legal reason whatsoever, in particular due to delay, impossibility of performance, positive breach of contract, culpa in contrahendo, consequential damage caused by defects, defects or tortious acts, are excluded unless they are based on intent or gross negligence on the part of the Museum of Lost Generation Art. This restriction does not apply to compensation for damage to persons and to items accepted for processing, or to claims based on the Product Liability Act. Minor deviations in the goods do not constitute a defect that triggers a warranty claim. As a matter of principle, the Museum Kunst der Verlorenen Generation cannot grant a guarantee unless we expressly declare this. The content of referenced or linked pages is expressly not part of this website. Any warranty or liability for the content of referenced pages is expressly excluded. The Museum of Lost Generation Art expressly distances itself from any illegal content on referenced pages and is not responsible for the content or functions of such websites.

 

8. Data protection

All information on data protection can be found in the privacy policy on the website of the Museum of Lost Generation Art at https://verlorene-generation.com/datenschutzerklaerung/.

 

9. Cancellation policy

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods (or, in the case of multiple goods ordered and delivered separately, the last goods). You may return the purchased goods to the Museum of Lost Generation Art, provided that the goods are complete and in unused and undamaged condition. Shrink-wrapped and/or sealed items will only be accepted if the shrink wrap is still unopened. This does not restrict your statutory right of withdrawal in any way. To exercise your right of withdrawal, you must inform us in writing of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or e-mail).

 

10. Consequences of revocation

If the customer revokes the concluded contract, the Museum Kunst der Verlorenen Generation must refund all payments received from the customer immediately and at the latest within fourteen days from the day on which the Museum Kunst der Verlorenen Generation received notification of the revocation of this contract. The Museum of Lost Generation Art may refuse to refund until it has received the goods back in their original packaging and has checked them for damage and completeness, or until the customer has provided proof that they have returned the goods, whichever is earlier. The customer must return or hand over the goods to the Museum Kunst der Verlorenen Generation immediately and in any case no later than fourteen days from the day on which the Museum Kunst der Verlorenen Generation is informed of the withdrawal from the contract. The deadline is met if the customer sends the goods before the expiry of the fourteen-day period. The customer bears the direct costs of returning the goods.

 

11. Miscellaneous

Deliveries and declarations of intent shall be made legally effective to the email address or postal address specified by the customer in the order until another email address or postal address is notified in writing. The customer is obliged to provide the relevant data requested in the contract completely and correctly when concluding the contract. In the event of incorrect, incomplete or unclear information, the customer shall be liable for all costs incurred by us as a result. The customer is obliged to notify us immediately in writing of any changes to their name, address or place of residence, otherwise they shall be liable for damages. In the event of failure to do so, any written communication sent to the last known email address or postal address shall be deemed to satisfy the requirements for effective delivery.
Customers are aware that the Internet is not a secure means of communication and that data sent via the Internet may be disclosed and altered by third parties. Customers bear the risk that data may not reach us or may not reach us in the form in which it was sent by the customer. We may trust that the data we receive was sent by the customer in the form in which we received it.
Austrian law applies. For entrepreneurs and consumers who are not domiciled or habitually resident in Austria and are not employed in Austria, the court with jurisdiction for 5020 Salzburg is agreed as the competent court for all legal disputes in connection with this contract, including its conclusion or termination.
 
We reserve the right to amend and adapt the general terms and conditions as necessary, whereby any amendments shall only apply to future contracts. The place of jurisdiction is the competent court in the city of Salzburg. Should any provision of these general terms and conditions be invalid, this shall not affect the validity of the remaining provisions.
